1. scope of application

The use of this website and the business relationship between Twing(www.twing.swiss, Twing Group AG, Blegistrasse 11B, 6340 Baar) and its customers are governed by the following General Terms and Conditions (GTC) in the version currently available and valid when the website is accessed or goods are ordered. The offer on this website is aimed exclusively at customers resident in Switzerland.

A customer is any natural or legal person who maintains a business relationship with Twing. The GTC, the terms of delivery and payment and the data protection provisions may be amended from time to time. Twing asks you to read these provisions carefully each time you visit the website and each time you order goods.

These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of Twing in order to be valid. When using this website or ordering goods, the customer confirms that he fully accepts these GTC, including the terms of delivery and payment.

Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Twing contains information about products and services. Prices, product ranges and technical specifications are subject to change without notice. All information on www.twing.ch/dev (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood only as approximate values and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Twing makes every effort to ensure that all details and information on this website are correct, complete, up-to-date and clear, but Twing cannot provide any express or tacit guarantee in this respect.

All offers on this website are subject to change and are not to be understood as binding offers.

Twing cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is subject to change at any time and without notice.

The product preview in the configurator is only a digital preview and may differ from the actual product. Twing and Dini Fläsche check incoming orders, but decline any liability if the product differs from the digital preview. Due to the engraving process, it is not recommended to use larger or more complex images and graphics for customization.

3. prices

Unless otherwise stated, the prices quoted by Twing include statutory VAT, any advance recycling fees (VRG) and copyright levies for electronic devices. The prices include VAT in Swiss francs (CHF).

Unless otherwise agreed, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.

Twing reserves the right to make technical changes, errors and misprints; in particular, Twing may change prices at any time and without prior notice. Consulting and support services are not included in the sales prices.

4. conclusion of contract

The offers on this website represent a non-binding invitation to the customer to order products and/or services from Twing. By placing an order via this website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. Twing then sends an automatic “order confirmation” by email, which confirms that the customer’s offer has been received by Twing. Orders placed are binding for the customer. The right of withdrawal applies in accordance with the GTC.

The contract is concluded as soon as Twing sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and if the goods are available. If it becomes apparent after conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, Twing is entitled to withdraw from the entire contract or from part of the contract. If the customer’s payment has already been received by Twing, the payment will be refunded to the customer. If no payment has yet been made, the customer shall be released from the obligation to pay. Twing is not obliged to make a replacement delivery in the event of the contract being terminated.

5. payment options, retention of title and reminders

Only the payment options specified in the order process are available to the customer.

Twing reserves the right to exclude customers from individual payment options or to insist on advance payment without giving reasons.

The products delivered to the customer remain the property of Twing until full payment has been made.

6 Delivery, obligation to inspect, notification of defects and return shipment

Deliveries are sent by post or courier service to the address specified by the customer in the order. Invoices are sent by email or by post. Benefit and risk are transferred to the customer upon dispatch.

The goods are normally dispatched within 4 working days of receipt of payment, but we reserve the right to delay delivery in exceptional cases. Claims for damages due to late or non-delivery are excluded. The delivery times do not apply to public holidays and days that are treated as public holidays (incl. Dec. 27-31).

If the delivery cannot be delivered or if the customer refuses to accept the delivery, Twing may terminate the contract after notifying the customer by email and setting a reasonable deadline, and may charge the customer for the costs incurred.

The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which Twing provides a warranty immediately in writing by letter or email to the address(Imprint).

Returns to Twing are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery bill and a detailed description of the defects to the return address specified by Twing (Twing Group AG, Blegistrasse 11B, 6340 Baar).

If the inspection by Twing reveals that the goods have no detectable defects or that they are not covered by the manufacturer’s warranty, Twing may charge the customer for the costs of the return shipment or any disposal.

7. right of withdrawal

The customer is granted a right of withdrawal for 100 calendar days after receipt of the goods. The deadline shall be deemed to have been met if the customer sends the written revocation by email(hallo@twing.swiss) or letter (Twing Group AG, Blegistrasse 11B, 6340 Baar) to Twing within the deadline. The revocation does not require any justification.

Exercising the right of withdrawal leads to a reversal of the contract. The customer must return the goods within 100 calendar days unopened in the original sealed packaging, complete with all accessories and together with the delivery bill to the return address specified by Twing (Twing Group AG, Blegistrasse 11B, 6340 Baar). Returns to Twing are made at the expense and risk of the customer. Any payment already made will be refunded to the customer within 30 calendar days, provided that Twing has already received the goods back or the customer can provide proof of shipment.

Twing reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the customer for it.

No right of withdrawal is granted in the following cases:

(i) If the contract has a random element, namely because the price is subject to fluctuations over which the supplier has no control.

(ii) If the subject of the contract is a movable item which, due to its nature, is not suitable for return or may spoil quickly;

(iii) If the subject of the contract is a movable item that is manufactured according to the consumer’s specifications or is clearly tailored to personal needs;

(iv) If the contract relates to digital content and this content is not provided on a fixed data carrier or if the contract is to be performed in full by both parties immediately;

(v) If the contract is for a service and the contract is to be performed in full by the supplier with the consumer’s prior express consent before the withdrawal period has expired.

8. warranty

Twing endeavors to deliver goods in perfect quality. In the event of defects notified in good time, Twing shall assume the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period of generally two years from the date of delivery. It is at the discretion of Twing to provide the warranty through free repair, equivalent replacement or reimbursement of the purchase price. Further claims are excluded.

The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances. The warranty for consumables and wearing parts (e.g. batteries, rechargeable batteries, etc.) is also excluded.

Since colors on screens can look different than on physical products (or due to technical differences in screens and printing processes), there may be slight color deviations from the product image compared to the final result. Liability for these deviations is excluded.

Twing is unable to give any assurances or guarantees for the topicality, completeness and correctness of the data or for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties not owned by Twing.

9. liability

Twing excludes all liability, irrespective of its legal basis, as well as claims for damages against Twing and any auxiliary persons and vicarious agents. In particular, Twing shall not be liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

Twing only uses hyperlinks to simplify the customer’s access to other websites. Twing cannot know the content of these websites in detail, nor can it assume any liability or other responsibility for the content of these websites.

All rights to the uploaded images remain with the author, i.e. usually the customer himself, provided he is the author. By uploading the images, the customer agrees that our partners may access these images for order processing, transfer them to the working memory of their data processing devices, view them and process them there using technical aids for order processing.

The customer assures to be the sole owner of all rights to all uploaded image files and not to infringe the rights of third parties by using the configurator, in particular the persons, objects or symbols depicted in the photos. Should third parties assert a violation of their rights to images or personal rights against us, the user of the uploaded images (customer) undertakes to indemnify Twing against all claims asserted against Twing and to compensate Twing in full for all damages resulting from the violation of rights.

The customer is prohibited from uploading images and files that contain punishable, illegal, immoral, pornographic or inciting content. In the event of non-compliance, Twing has the right to delete such orders and files without notice and, if necessary, to inform the relevant criminal authorities.

The customer is solely responsible for all content of the uploaded images. He must therefore ensure that he holds the rights of use for the necessary copyrights or trademark rights for all images transferred to Twing. All consequences arising from infringements of rights shall be borne solely by the customer. He is therefore obliged to indemnify Twing against all justified claims asserted against third parties due to an infringement and to bear these himself.

The engraving is only commissioned after receipt of payment and is automatically sent to the customer by post within 2-5 working days of completion. The engraving cannot be returned because it is not to the customer’s liking, as it is a custom-made product and is therefore clearly tailored to personal requirements.

Complaints due to technical defects can only be made to our customer service department within 4 working days of delivery. Only technical defects, but not personal or taste-related reasons, are considered grounds for complaint. Defects that arise due to misleading, inadequate or inaccurate information when the order is created or due to incorrect and incorrect use of our configurator are excluded from a complaint; this also applies to deviations of a repeat order from an initial order. All other claims for reduction, rescission or compensation are excluded. In the event of a justified complaint, we undertake to make a replacement delivery.

10. data protection

Twing collects and processes personal data in accordance with the Twing Privacy Policy. Twing may process the data collected during the conclusion of the contract in order to fulfill the obligations arising from the purchase contract. The data required to fulfill the service may also be passed on to contracted service partners (logistics partners) or other third parties. Privacy policy

11 Further provisions

Twing expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice.

In the event of disputes, Swiss substantive law shall apply exclusively to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is Zug, unless the law provides for mandatory places of jurisdiction.
